Terms and Conditions

1.     Agreement between You and Unwrap Your Map

Welcome to www.unwrapyourmap.com. The www.unwrapyourmap.com website (the "Website") is an e-commerce website operated by Unwrap Your Map LLC ("Unwrap Your Map," “we,” “us,” or “our”). These terms and conditions (the “Terms”) cover your use of and access to the Website. By using the Website, you agree to be bound by these Terms. Please read the Terms carefully and keep a copy of them for your reference.

Unwrap Your Map maintains the Website to advertise the sale of one-on-one coaching packages (the “Coaching Services”) and travel guides or photographs, whether in digital or physical form (the “Travel Products”). This agreement governs your use of the Website and the Travel Products. Your use of the Coaching Services is governed by the applicable Coaching Services Agreement (each, a “CSA”) between you and Unwrap Your Map.

2.     Privacy

Your use of the Website is also subject to Unwrap Your Map's Privacy Policy. Please review our Privacy Policy, which also governs the Website and informs users of our data collection practices.

3.     Electronic Communications

Visiting the Website or sending emails to Unwrap Your Map constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that Unwrap Your Map provides to you electronically, via email and on the Website, satisfy any legal requirement that such communications be in writing.

4.     Your Responsibilities

If you use this Website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Unwrap Your Map is not responsible for third party access to your account that results from theft or misappropriation of your account.

You agree to take full responsibility for any harm or damage you suffer as a result of the use, or non-use, of the information available on this Website or the resources available for download from this Website, including, but not limited to, the Travel Products. You agree to use reasonable judgment and conduct due diligence before taking any action or implementing any plan or policy suggested or recommended on this Website. Unwrap Your Map reserves the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

5.     Children Under Thirteen

Unwrap Your Map does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use the Website only with permission of a parent or guardian.

6.     Payments and Cancellations.

a.     Travel Products.

        i.     General. Payments for Travel Products shall be made as specified on the Website. For all Travel Products other than photographs, all sales are final. Unwrap Your Map shall not issue any refunds for any such Travel Products once payment has been made.  

     ii.     Photography. Purchases of photographs, including requests for refunds or cancellations, are subject to the terms and discretion of the applicable third party service provider.

b.     Coaching Services. For Coaching Services, payment and cancellation terms shall be governed by the applicable CSA between you and Unwrap Your Map.

7.     Links to Third Party Websites and Third Party Services

The Website may contain links to other websites (each a "Linked Website", together the “Linked Websites”). The Linked Websites are not under the control of Unwrap Your Map and Unwrap Your Map is not responsible for the contents of any Linked Website, including without limitation any link contained in a Linked Website, or any changes or updates to a Linked Website. Unwrap Your Map is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Unwrap Your Map of the Website or any association with its operators.

Certain services made available via the Website are delivered by third party websites and organizations. By using any product, service or functionality originating from the Website domain, you hereby acknowledge and consent that Unwrap Your Map may share such information and data with any third party with whom Unwrap Your Map has a relationship to provide the requested product, service or functionality on behalf of the Website’s users and customers.

8.     Intellectual Property and Acceptable Use

You are granted a non-exclusive, non-transferable, revocable license to access and use the Website and the Travel Products strictly in accordance with these Terms. As a condition of your use of the Website, you warrant to Unwrap Your Map that you will not use the Website for any purpose that is unlawful or prohibited by these Terms. You may not use the Website in any manner which could damage, disable, overburden, or impair the Website or interfere with any other party's use and enjoyment of the Website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Website.

All content included on the Website, such as text, graphics, logos, images, compilation thereof, and any software used on the Website, is the property of Unwrap Your Map or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Website or in the Travel Products. Unwrap Your Map content is not for resale. Your use of the Website and the Travel Products does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Unwrap Your Map and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. Unwrap Your Map does not grant you any licenses, express or implied, to the intellectual property of Unwrap Your Map or our licensors except as expressly authorized by these Terms.

9.     Third Party Accounts

You will be able to connect your Unwrap Your Map account to third party accounts. By connecting your Unwrap Your Map account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party Websites). If you do not want information about you to be shared in this manner, do not use this feature.

10.  International Users

The Website is controlled, operated and administered by Unwrap Your Map from its offices within the United States. If you access the Website from a location outside the United States, you are responsible for compliance with all local laws. You agree that you will not use the content of the Website in any manner prohibited by any applicable laws, restrictions or regulations.

11.  Indemnification

You agree to indemnify, defend and hold harmless Unwrap Your Map, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Website or Travel Products, any user postings made by you, your violation of any terms of these Terms or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Unwrap Your Map reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Unwrap Your Map in asserting any available defenses.

12.  Disclaimer of Liability

THE INFORMATION, SOFTWARE, TRAVEL PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE WEBSITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. UNWRAP YOUR MAP AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE WEBSITE AT ANY TIME.

UNWRAP YOUR MAP AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, TRAVEL PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE WEBSITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. UNWRAP YOUR MAP AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE WEBSITE OR THE TRAVEL PRODUCTS, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE WEBSITE OR TRAVEL PRODUCTS.

AS FURTHER DISCUSSED IN SECTION 19 AND NOTWITHSTANDING THE ABOVE, FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE COACHING SERVICES, THE CSA SHALL GOVERN.

13.  Term and Termination

These Terms shall be effective as of the date you first access the Website or the Travel Products and shall remain in effect for so long as you use or access the Website or the Travel Products. Unwrap Your Map reserves the right, in its sole discretion, to terminate your access to the Website, the Travel Products, and the related services or any portion thereof at any time, without notice.

14.  Governing Law

To the maximum extent permitted by law, these Terms are governed by the laws of the State of Washington and you hereby consent to the exclusive jurisdiction and venue of courts in Washington in all disputes arising out of or relating to these Terms. Use of the Website or of the Travel Products is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

15.  Relationship of Parties

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Unwrap Your Map as a result of these Terms or use of the Website. Unwrap Your Map's performance of these Terms is subject to existing laws and legal process, and nothing contained in these Terms is in derogation of Unwrap Your Map's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Website, the Travel Products, or information provided to or gathered by Unwrap Your Map with respect to such use.

16.  Enforceability

If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms shall continue in effect.

17.  Entire Agreement

Unless otherwise specified herein, these Terms constitute the entire agreement between you and Unwrap Your Map with respect to the Website and the Travel Products and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Unwrap Your Map with respect to the Website and the Travel Products. A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English. 

18.  Changes to Terms

Unwrap Your Map reserves the right, in its sole discretion, to change the Terms under which www.unwrapyourmap.com is offered. The most current version of the Terms will supersede all previous versions. Unwrap Your Map encourages you to periodically review the Terms to stay informed of updates.

19.  Conflicts of Terms.

In the event of any conflict or inconsistency between these Terms and the terms of a CSA, the terms of the CSA shall govern.
